Definition

Bandehåndhævelse (gang enforcement) describes the use of unlawful force, threats, extortion, or other coercive measures by criminal groups to maintain internal control, settle disputes, collect debts, or sanction members and associates who violate gang norms. It is not a standalone legal offense in Danish law, but rather a descriptive concept used in practice, investigative journalism, and true crime coverage to characterize actions carried out by organized criminal networks in lieu of legitimate legal processes.

The criminal liability arising from gang enforcement depends on the specific acts committed. Common charges include assault, threats, extortion, coercion, unlawful deprivation of liberty, and complicity in such offenses. The Danish Criminal Code does not contain a dedicated provision labeled "gang enforcement," but certain aggravating circumstances apply when crimes are committed in a gang context or to intimidate witnesses, victims, or public officials.

Section 81, paragraph 6 of the Danish Criminal Code (Straffeloven) is particularly relevant, as it establishes that an offense is considered more serious if it is directed against a person performing lawful work or public duties. While this provision primarily targets attacks on authority figures, gang enforcement often involves targeting individuals in their roles as debtors, rival members, or perceived informants—contexts where other statutory provisions and sentencing guidelines come into play.

Gang enforcement typically manifests as retaliatory violence, punishment beatings, kidnappings for ransom or intimidation, destruction of property, and threatening communications. These actions serve to reinforce the gang's authority, deter cooperation with law enforcement, and signal consequences to both internal and external actors. The judiciary treats such conduct seriously, particularly when it undermines public order or witnesses' willingness to testify.

In Danish criminal proceedings, evidence of gang affiliation and the motive of enforcing gang rules or debts can influence both the selection of charges and sentencing outcomes. Prosecutors may invoke general provisions on organized crime, aggravated assault, or witness intimidation, depending on the factual matrix. The concept of bandehåndhævelse thus functions as a practical lens through which law enforcement, courts, and commentators understand patterns of violence rooted in gang dynamics, even though the term itself carries no independent statutory meaning.
