The concept gained practical legal significance with the introduction of enhanced sentencing provisions specifically targeting gang-related crime. When violent offenses—including serious assaults, homicides, weapons possession, or violence and threats against witnesses—are committed as part of a gang conflict, courts may impose significantly increased penalties beyond the standard sentencing framework for the underlying offense. This approach reflects legislative intent to combat organized criminal violence through deterrent sentencing.

Bandevold functions primarily as a contextual aggravating factor rather than as an independent criminal charge.
