Definition

Bandekriminalitet (gang crime) refers to criminal activity committed in connection with rocker clubs or criminal gangs in Denmark. While not a standalone criminal offense, the term has specific legal significance through the so-called "gang paragraph" in Danish criminal law, which provides a framework for enhanced punishment when crimes are linked to gang conflicts.

The primary legal mechanism is found in Section 81a of the Danish Penal Code (Straffeloven), which authorizes increased sentences for certain criminal offenses committed as part of conflicts between rocker clubs or gangs, or when the crime is likely to provoke such conflicts. This provision was introduced to address the serious public safety concerns arising from violent confrontations between organized criminal groups, particularly during periods of heightened gang warfare.

The provision applies when a crime has its background in a conflict between rocker clubs or gangs, or when the offense is of a nature that may trigger or escalate such conflicts. However, the precise legal meaning derives from the application of Section 81a rather than from a specific legal definition of the term itself. The provision reflects Danish criminal policy's focus on disrupting organized crime structures and deterring the violent cycles that characterize gang conflicts.

Note that the correct Danish term is "bandekriminalitet" (with 'd'), not "banekriminalitet." The provision forms part of Denmark's comprehensive legislative response to gang-related violence, complementing other measures such as visitation zones and association restrictions targeting organized criminal groups.
