Definition

Bestilte drab (contract killing or murder-for-hire) refers to an intentional homicide where one person (the perpetrator) kills another at the request, arrangement, or commission of a third party (the instigator). Under Danish law, this remains prosecuted as manddrab (homicide) under Straffeloven § 237, which carries a penalty ranging from 5 years imprisonment to life imprisonment. The term "bestilte drab" itself is not a distinct legal category in the Danish Penal Code, but rather a descriptive designation commonly used in legal practice, media coverage, and true crime discourse to characterize the circumstances and motive behind the killing.

The critical element in Danish criminal law is the presence of forsæt (intent) to kill. The fact that the murder was commissioned or ordered does not alter the fundamental legal assessment under § 237, though it may influence sentencing considerations. Both the person who carries out the killing and the person who orders it can be held criminally liable—the perpetrator for committing the homicide, and the instigator potentially under rules regarding complicity or instigation of criminal acts.

In cases involving planned or commissioned killings, the degree of premeditation, the nature of any agreement or payment, and the relationship between the parties involved typically factor into the court's assessment during sentencing. Circumstances such as careful planning, cold calculation, or financial motivation may be regarded as aggravating factors that justify a more severe sentence within the statutory range. However, the underlying offense remains manddrab as defined in § 237.

The term is particularly relevant in true crime contexts where criminal networks, personal vendettas, or organized crime elements are involved. Danish legal proceedings treat such cases with particular seriousness due to the calculated nature of the crime and the involvement of multiple parties in the planning and execution of the homicide.
