Definition

DNA evidence refers to biological material containing deoxyribonucleic acid that is collected, preserved, and analyzed to establish identity or link individuals to criminal activity. Common sources include blood, saliva, semen, hair with follicles, skin cells, and other bodily fluids or tissues left at crime scenes or on victims and objects. DNA evidence has become one of the most powerful tools in criminal investigations since its introduction in the mid-1980s, offering an unprecedented level of individualization when sufficient genetic markers are analyzed.

In the United States federal system, the collection and use of DNA identification information is governed by statutes including 34 U.S.C. § 40702, which authorizes the Attorney General to collect DNA samples from certain arrested individuals, those facing charges, convicted offenders, and others in federal custody. These samples are analyzed and the resulting profiles are typically stored in databases such as the Combined DNA Index System (CODIS), which enables law enforcement to compare crime scene DNA against known profiles and identify matches across jurisdictions. The federal DNA collection framework balances investigative needs with privacy considerations through regulations on sample collection, retention, and expungement.

The evidentiary value of DNA depends heavily on proper collection, chain of custody documentation, laboratory analysis standards, and statistical interpretation. Contamination, degradation, or handling errors can compromise DNA evidence. Analysts typically examine multiple genetic markers (loci) and calculate the probability that a random person would share the same profile, often yielding statistics like "one in several billion" for full profile matches. However, challenges can arise with mixed DNA samples, partial profiles, or when relatives share genetic similarities.

DNA evidence has proven instrumental in both convicting guilty parties and exonerating wrongfully convicted individuals. Post-conviction DNA testing has led to hundreds of exonerations in the United States, revealing the limitations of earlier forensic methods and eyewitness testimony. Modern true crime cases frequently hinge on advances such as touch DNA (from skin cells on handled objects) and forensic genetic genealogy, where crime scene DNA is compared against public genealogy databases to identify suspects through family connections, as famously demonstrated in the Golden State Killer case.
