Landsretten is a regional appellate court in the Danish judicial system, serving as the intermediate level of review between the district courts (byretter) and the Supreme Court (Højesteret). Denmark has two landsretter: Østre Landsret (Eastern High Court) in Copenhagen with jurisdiction over eastern Denmark including Zealand and Bornholm, and Vestre Landsret (Western High Court) in Viborg with jurisdiction over Jutland and Funen.
In criminal cases, landsretten functions as an appellate court reviewing convictions, sentences, and acquittals from the district courts. Appeals can address both questions of law and questions of fact, including reassessment of evidence and witness credibility. The court typically sits in panels of three professional judges, though serious criminal cases may include lay judges (domsmænd) in addition to professional judges, depending on whether the case is heard as an appeal or a completely new trial (prøvelse).
The landsretter hear a wide range of criminal appeals, from minor offenses to serious felonies including homicide, organized crime, and major fraud cases. Defendants have a statutory right to appeal convictions and sentences, while prosecutors can appeal acquittals or sentences they consider too lenient. The appellate review may result in confirmation, modification, or reversal of the lower court's decision.
The term "landsret" literally translates to "land court" or "country court," reflecting its historical role as a regional court with jurisdiction over larger geographic areas than local courts. This intermediate appellate tier is common in European civil law jurisdictions but has no direct equivalent in the U.S. federal system, where appeals from district courts go directly to circuit courts of appeals, and there is no regional division comparable to Denmark's two landsretter.
