Definition

Uløste sager, or unsolved cases, refers to criminal investigations that have not resulted in the identification, arrest, or successful prosecution of a perpetrator. These cases remain open in law enforcement records and may be subject to ongoing or periodic investigation as new evidence or investigative techniques become available.

In American federal law, there is no specific statutory definition of "unsolved cases" as a legal term. Rather, it is a descriptive classification used by law enforcement agencies to categorize investigations that have not been cleared by arrest or exceptional means. The resolution status of a case depends on whether investigators have established probable cause, identified a suspect, and gathered sufficient evidence for prosecution.

The ability to prosecute unsolved cases is generally governed by statutes of limitations, which set time limits for bringing criminal charges. Under federal law, most non-capital offenses are subject to a five-year statute of limitations as established in 18 U.S.C. § 3282. However, capital offenses and certain serious crimes have no time limitation, meaning these cases can theoretically remain open and prosecutable indefinitely.

Modern forensic advances, particularly DNA analysis and digital forensics, have enabled law enforcement to revisit cold cases and potentially solve crimes that remained unresolved for decades. Many jurisdictions maintain dedicated cold case units that systematically review unsolved cases, applying contemporary investigative methods to historical evidence. The term has become particularly prominent in true crime discourse, where public interest often focuses on notorious unsolved murders, disappearances, and other serious crimes that continue to captivate investigative attention despite the passage of time.
